This proposal is considered to be superior to the earlier applications as it eliminates the earlier objections to the detrimental impact of car headlight glare, the manoeuvring of vehicles on the roof, the inability to control the unauthorised standing of vehicles on the roof and the visual annoyance of the open carport and parking. Furthermore, if the rooftop balustrade and recreational use of the roof is not allowed by Council, the other objections relating to loss of amenity, reduced privacy and overall increase in height across the building will also be removed.

The widened garage will obstruct a small proportion of the excellent water views from premises 29 Southern Street and this remains as the most significant objection to the proposal of the matters raised by the objectors, subject again to the deletion of the rooftop balustrade.

A strong thrust in the objections is the concern that the proposal, if approved, will make the way easy for a future subdivision, it being noted that deficiency in carparking and manoeuvring of cars was a substantial reason for the appeal against Council's refusal of a subdivision application being disallowed.

After considering all the issues and the merits of the proposal, it is considered that the application may be approved subject to suitable conditions.
